Hereinafter referred to as "Bid2Drive", "we", "us" or "the Company".

2. Terms and Conditions of Use

2.1. Purpose of the Website

The website bid2drive.ro presents the services offered by Bid2Drive: the evaluation of damaged vehicles available at auctions in the United States of America, for the purpose of import into Romania. The information published on the website is provided for informational purposes only and does not constitute a contractual offer within the meaning of the Romanian Civil Code.

2.2. Use of the Website

By accessing and using the website, you accept these terms and conditions. If you do not agree with them, please do not use the website.

You agree to use the website in accordance with applicable law and not to:

  • submit through the contact form any information that is false, misleading, or infringes the rights of third parties;
  • attempt to interfere with the operation of the website (cyber attacks, unauthorized access, automated data extraction);
  • use the website for illegal or fraudulent purposes.

2.3. Estimative Nature of the Evaluations

The evaluations and estimates provided by Bid2Drive (including those generated with the help of artificial intelligence technologies) are indicative only. They are based on the information and photographs publicly available at the time of the evaluation and do not constitute a guarantee regarding the actual condition of the vehicle, the final repair costs, the applicable taxes, or the resale value. The decision to bid on or purchase a vehicle rests exclusively with the client.

2.4. Intellectual Property

The content of the website (texts, graphics, logo, structure, visual elements) is the property of Bid2Drive or is used with the consent of the rights holders and is protected by copyright legislation. Reproduction, distribution, or use of the content without the prior written consent of Bid2Drive is prohibited.

2.5. Limitation of Liability

Bid2Drive makes reasonable efforts to ensure that the information on the website is accurate and up to date, but does not guarantee its accuracy, completeness, or timeliness. To the extent permitted by law, Bid2Drive shall not be liable for:

  • direct or indirect damages resulting from the use of, or inability to use, the website;
  • purchasing decisions made solely on the basis of the estimative information on the website;
  • the content of third-party websites to which links may exist.

2.6. Governing Law and Jurisdiction

These terms are governed by Romanian law. Any dispute shall be resolved amicably or, failing that, by the competent courts of Romania.

3. Privacy Policy (Protection of Personal Data)

Bid2Drive processes personal data in accordance with Regulation (EU) 2016/679 ("GDPR") and applicable national legislation (Romanian Law no. 190/2018).

3.2. What Data We Collect

a) Data provided directly by you, through the contact form:

  • name;
  • email address;
  • phone number;
  • the VIN of the vehicle for which you request an evaluation (and, optionally, any other details included in your message).

b) Data collected automatically, through cookies and similar technologies (details in Section 4):

  • technical data (IP address, browser type, device, pages visited);
  • advertising identifiers, to the extent you have given your consent.

3.3. Purposes and Legal Bases of Processing

3.4. Who We Disclose Data To

We do not sell or transfer your data to third parties for their own commercial purposes. Your data is used exclusively for our internal business purposes described above.

For the operation of the website and of our business, data may be accessed by a limited number of service providers (processors or independent controllers), strictly to the extent necessary:

  • hosting and IT infrastructure service providers;
  • Google (the reCAPTCHA, Google Analytics, Google Tag Manager, and Google Ads services);
  • public authorities, where required by law.

3.5. Transfers Outside the European Economic Area

Some providers (Google) may process data outside the EEA, including in the United States. These transfers take place on the basis of appropriate safeguards under the GDPR, such as the EU–US Data Privacy Framework or the standard contractual clauses approved by the European Commission.

3.6. How Long We Keep Data

  • Contact form data: for the duration of handling your request and thereafter for a period of up to 3 years, for record-keeping of communications and the defense of our rights, after which it is deleted or anonymized.
  • Data collected through cookies: according to the retention periods described in Section 4 and in the consent management tool.

3.7. Your Rights

Under the GDPR, you have the following rights:

  • the right of access to the data being processed;
  • the right to rectification of inaccurate data;
  • the right to erasure ("the right to be forgotten"), under the conditions of the law;
  • the right to restriction of processing;
  • the right to data portability;
  • the right to object, in particular to processing based on legitimate interest;
  • the right to withdraw your consent at any time, without affecting the lawfulness of prior processing;
  • the right not to be subject to a decision based solely on automated processing that produces legal effects concerning you.

3.8. Data Security

We apply reasonable technical and organizational measures to protect data against unauthorized access, loss, or accidental disclosure, including encrypted communications (HTTPS) and restricted access to data.
